As consideration for being allowed to enter, utilize, and participate in any activities, programs, and/or training at Real Athletic Development LLC (the “Facility”), the undersigned, on their own behalf and on behalf of the minor participant(s) identified below, acknowledges, understands, and agrees to the following:
Authority to Sign.
I represent that I am the parent or legal guardian of the participant(s) named below, or that I have obtained permission from the parent or legal guardian of the participant(s) to execute this agreement on their behalf.
Acknowledgment of Risks.
I acknowledge and understand that participation in baseball and sports-related activities involves known and unknown risks, including but not limited to: impact from baseballs, bats, and other equipment; muscle strains and sprains; contusions; fractures; concussions; eye injuries; dental injuries; paralysis; and death.
Assumption of Risk.
I, for myself and the participant(s) named below, voluntarily assume all risks associated with the use of the Facility, including risks arising from Facility equipment, or failure to follow Facility rules and instructions from Facility staff and coaches. I, for myself and the Participant(s) named and in my care, willingly assume all risks associated with participation in any activities at the Facility and accept that there are also risks that may arise due to OTHER PARTICIPANTS which I also willingly assume.
Scope of Agreement – Premises Liability.
I acknowledge and agree that this waiver extends to all areas of the Facility, including but not limited to common areas, parking lots, and any spaces owned, leased, or used by Real Athletic Development LLC.
Compliance with Rules and Instructions.
I agree that the participant(s) named below and I will comply with all Facility rules, posted safety guidelines, and instructions from Facility staff and coaches as a condition of participation.
Release and Waiver of Liability.
I, for myself and the participant(s) named below, our heirs, assigns, representatives, and next of kin, expressly release, waive, discharge, and hold harmless Real Athletic Development LLC, its owners, members, managers, officers, employees, agents, contractors, sponsors, and affiliates (“Released Parties”) from any and all claims, liabilities, damages, or causes of action resulting from injury, disability, death, or property damage arising out of participation in activities at the Facility, whether arising from negligence or otherwise, to the fullest extent permitted by law.
Indemnification.
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, actions, damages, or expenses (including attorney’s fees) resulting from my own or my child’s participation in Facility activities, including claims brought by third parties.
Medical Treatment Authorization.
In the event of an injury, I authorize Real Athletic Development LLC to obtain necessary medical treatment for myself and the participant(s) listed below, and agree to be financially responsible for any medical expenses incurred.
Photo and Media Release.
I understand that participation in activities at the Facility constitutes consent for Real Athletic Development LLC to use photos, videos, or other media likenesses of the participant(s) for promotional purposes without compensation.
No Liability for Personal Property.
I acknowledge and agree that Real Athletic Development LLC is not responsible for lost, stolen, or damaged personal property brought into the Facility or onto its premises.
Severability.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Binding Arbitration.
Any dispute arising from this Agreement shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles, California. The laws of the State of California shall govern this Agreement, without regard to any conflict of laws principles thereof.
Acknowledgment of Understanding.
I have read and fully understand this Agreement. I understand that by signing, I am waiving certain legal rights, including the right to sue the Released Parties for injuries or damages. I sign this Agreement freely and voluntarily without inducement.
